Terms and Conditions

Last Updated: 22nd July 2025

For creators: You can record, stream, and monetise The Home County (music included). See Section 3A for the full terms.

1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your use of the The Home County website (the “Website”) and the The Home County video game (the “Game”), both developed and operated by Studio Swanworth Limited (“Studio Swanworth,” “we,” “us,” or “our”). By accessing the Website or downloading/playing the Game, you agree to comply with and be bound by these Terms . If you do not agree with any part of these Terms, you must not use the Website or the Game .

Please review our separate Privacy Policy to understand how we collect and use personal data (data privacy matters are addressed there, not in these Terms). Note that the Game may be purchased or downloaded via third-party platforms (such as Steam); those platforms have their own terms which govern your purchase, but your use of the Game itself and the Website remains subject to these Terms. Studio Swanworth Limited is the owner and operator of the Website and Game, and all access to these services is provided conditioned on your acceptance of these Terms.

2. Intellectual Property Rights

All content, features, and functionality of the Website and Game – including but not limited to software, code, artwork, graphics, text, images, logos, audio, and game mechanics – are the exclusive property of Studio Swanworth Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws . Your use of the Website and Game does not grant you any ownership of any intellectual property rights in their content; you are only granted the limited rights explicitly set forth in these Terms. You may not use, copy, or reproduce any content from the Website or Game in any manner not expressly permitted by these Terms without our prior written consent .

3. License and Acceptable Use

Subject to your compliance with these Terms, Studio Swanworth Limited grants you a personal, non-exclusive, non-transferable, limited license to access and use the Website and to download and play the Game for your own personal, non-commercial entertainment use. You agree not to use the Website or Game for any commercial purpose without explicit permission from us.

Under this license, you agree that you will NOT:

  • Copy, modify, distribute, or reverse-engineer any part of the Game or Website software/content . This includes not decompiling the Game’s code or attempting to extract or reuse source code or design elements.
  • Create derivative works or adaptations of the Game or Website, or otherwise exploit the Game or Website or any part of their content for any unauthorized purpose.
  • Use the Game or Website for unlawful activities or in any way that violates any applicable laws or regulations . You must not use the services to engage in fraudulent, offensive, or illegal conduct.
  • Interfere with or disrupt the normal operation of the Game or Website. For example, you shall not attempt to hack, cheat, inject malicious code, initiate denial-of-service attacks, or otherwise harm the functionality of our software or servers .
  • Bypass or disable security measures on the Game or Website, or attempt to gain unauthorized access to systems or data not intended for you .

Any violation of the above conditions is strictly prohibited and constitutes grounds for termination of your right to use the Website and Game. We reserve the right to suspend or terminate your access to the Website or Game if we believe you have violated these Terms. You are responsible for ensuring that your use of the Game and Website is in line with these rules and for any consequences of breaching them.

3A. Content Creation & Monetisation Licence

We love seeing videos, streams, screenshots, guides, memes, and other fan-made content about the Game (“Creator Content”). So, subject to these Terms, Studio Swanworth Limited grants you a worldwide, non-exclusive, royalty-free licence to:

  • Capture, reproduce, and publicly display audio-visual output from the Game (including in-game music and sound effects);
  • Edit and combine that footage with your own content; and
  • Publish, distribute, and monetise Creator Content on platforms such as YouTube, Twitch, TikTok, and similar services (including via ad revenue, sponsorships, tips, subscriptions, and similar monetisation tools).

Conditions:

No standalone asset dumps. Do not redistribute our raw assets (e.g., soundtrack files, sprites, 3D models, code) outside of normal gameplay capture.

No misleading or unlawful use. Don’t present Creator Content as official, endorse illegal activity, or infringe third-party rights.

Music ID claims. Automated copyright claims may occur on some platforms. If you get an erroneous claim on Game audio, contact us at contact@thehomecounty.com and we’ll try to help.

No paywalling the Game itself. You can monetise your videos/streams, but you can’t sell access to the Game or its assets.

Revocation for abuse. We may revoke this licence for specific content if it is hateful, harassing, or otherwise violates these Terms or applicable law.

Our Website may contain links or references to third-party websites and platforms (for example, a link to the Steam store page for purchasing The Home County). These links are provided for your convenience, and any purchase or download of the Game will actually be made through such third-party platforms, not directly from us. Studio Swanworth Limited is not responsible for the content, products, services, or actions of any third-party websites or platforms . When you click on a link to an external platform (such as Steam), you understand that you will be subject to that third party’s own terms and policies, and we disclaim any liability for issues arising from transactions or interactions on those platforms .

Please refer to the terms and conditions and support resources of the relevant third-party platform for any issues related to purchasing, downloading, or playing the Game through that platform. Studio Swanworth does not have control over third-party services and does not assume responsibility for any loss or damage resulting from your use of third-party websites. Any inclusion of a third-party link on our Website does not imply our endorsement of that third party’s site or services . You use all third-party links at your own risk.

5. Disclaimer of Warranties

The Website and the Game are provided “as is” and “as available,” without warranty of any kind. Studio Swanworth makes no representations or guarantees that the Website or Game will be uninterrupted, error-free, or free of viruses or other harmful components . To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement .

You understand that use of the Website and Game is at your own risk. We do not warrant that the Game will function on or be compatible with every device or system configuration, nor that any content on the Website (including any information or downloads) is accurate or reliable. Studio Swanworth does not guarantee that any bugs or errors in the Game or Website will be corrected, or that the Game or Website will meet your expectations or requirements. All information and services provided through the Website or Game are also provided without any endorsement or warranty .

Except where explicitly provided otherwise (for example, via refund policies of a third-party platform or as required by law), we provide no warranty or guarantee for any outcomes from using the Game (such as in-game progress, achievements, or fitness for any gameplay purpose). If you are dissatisfied with the Website or Game, your sole remedy is to stop using them.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Studio Swanworth Limited will not be liable for any damages or losses arising out of or in connection with your use of (or inability to use) the Website or the Game. This exclusion of liability applies to all forms of damages, whether direct, indirect, incidental, consequential, special, exemplary, or punitive . In particular, Studio Swanworth will not be responsible for losses such as loss of profits, loss of data (including any game progress), business interruption, or damage to equipment arising from the use of our Game or Website. You assume all responsibility for any results obtained from the use of the Game or Website, and for any damage to your computer system or device that may result from using them or downloading content.

By using the Website or Game, you agree to indemnify and hold Studio Swanworth (and its directors, officers, and employees) harmless from any claims, liabilities, damages, or expenses (including legal fees) arising out of your use of the Website or Game, or your violation of these Terms . This means you will defend and reimburse us if any third party makes a claim against us due to your breach of these Terms or misuse of the services.

Nothing in these Terms limits or excludes our liability for any matter that cannot be limited or excluded by law – for example, we do not exclude liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation . If applicable law does not allow certain liability exclusions or limitations, then our liability will be limited to the maximum extent permitted by law. In jurisdictions that do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, some of the disclaimers and limitations in these Terms may not fully apply to you. However, in such cases, all other provisions of these Terms shall remain in full force.

7. Updates and Modifications to the Game and Website

Studio Swanworth reserves the right to update, modify, or discontinue the Website, the Game, or any portion or feature thereof at any time. We may from time to time provide patches, updates, or new versions of the Game. Such updates may be required for you to continue using the Game (for example, to maintain compatibility or security). We do not guarantee that we will provide any specific updates or that we will continue to support the Game indefinitely.

We may also suspend or shut down the Website (for maintenance, upgrades, or permanently) or make changes to its content at our discretion. These changes may occur without prior notice to you . You agree that Studio Swanworth shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Game or Website. If a change or update requires new Terms or a separate agreement (for example, an updated End User License Agreement for a major Game update), you may be required to review and accept such new terms before continuing use.

8. Changes to These Terms

We may revise or update these Terms from time to time as our Game, Website, or business practices evolve. Studio Swanworth Limited reserves the right to change these Terms at any time without prior individual notice . Updated versions of the Terms will be posted on the Website with a new “Last Updated” date. Please check this page regularly to ensure you are familiar with the current version of the Terms .

By continuing to use the Website or Game after any revisions become effective, you indicate your acceptance of the updated Terms . If you do not agree to the revised Terms, you should discontinue use of the Website and Game. We may, at our discretion, also inform users of significant changes through other means (such as an in-game notification or email, if appropriate), but it remains your responsibility to review the Terms periodically for any changes.

9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales . This choice of law applies regardless of your location, though if you are a consumer residing in another country, you may also have certain mandatory legal rights under the laws of that country. Any dispute or claim arising out of or in connection with these Terms, the Website, or the Game (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of England and Wales . By using the Website or Game, you consent to the jurisdiction of such courts for resolving any disputes.

10. Miscellaneous

No Waiver: If we do not insist on or enforce strict performance of any provision of these Terms, it shall not be considered a waiver of any right or provision. Similarly, any delay or omission in exercising our rights or remedies shall not waive that right or remedy.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect . We intend that these Terms be enforced to the maximum extent permitted by law, and agree that any invalid or unenforceable term will be deemed modified to the minimum extent necessary to make it valid and enforceable.

No Third-Party Rights: These Terms are between you and Studio Swanworth Limited. No other person or entity shall have any rights to enforce any term of this agreement, and the Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms .

Entire Agreement: These Terms (along with any additional terms expressly incorporated by reference, and our Privacy Policy) constitute the entire agreement between you and us regarding the use of the Website and Game. They supersede any prior agreements or understandings, whether written or oral, relating to this subject matter.
